Albany Didn’t “Cut” the MTA Budget. They Stole From It. [Streetsblog New York City]
As part of December's deficit reduction package, Albany lawmakers took dedicated transit tax revenue from the MTA to fund other parts of the state budget. All dollar figures in millions.The overwhelming majority of the $143 million reduction in transit funding did not originate from the state budget. Instead, Albany took dedicated transit tax revenues from the MTA and redirected them to the state's general fund. In effect, Albany stole $118 million from transit to subsidize the rest of the state budget. That's enough money to restore all the subway and bus cuts currently on the table in the MTA's austerity plan.
How did they pull off the heist? To explain, we need to give a short intro to the MTA operating budget.
In addition to fares and tolls, MTA service is mainly funded by an array of dedicated taxes, which total about $4.5 billion every year. A smaller portion comes from "state and local subsidies," of which Albany is supposed to contribute about $190 million. Already, we're only talking about a small fraction of the MTA's nearly $12 billion operating budget.
But here's the thing -- Albany's "contribution" consists almost entirely of tax revenue that's already dedicated to transit. This year, Albany put just $7 million from the general fund into MTA operations, according to the state Division of the Budget. The rest of its obligation to the MTA -- $183 million -- came from dedicated transit taxes.
So when the state made off with $143 million from the MTA budget in the December deficit reduction package, lawmakers were not reducing the state's contribution to transit so much as raiding the MTA piggy bank and robbing transit riders of funds collected specifically to serve them. When all was said and done, Albany had taken $118 million from dedicated MTA taxes.
(The remainder was accounted for by a $19 million cut in state funding for student fares and the elimination of $6 million in state operating support.)
In a statement released last fall, Gary Dellaverson, who has since retired as the MTA's chief financial officer, noted that this was "the first time that an existing appropriation to MTA has been reduced under circumstances in which the money was derived from a 'dedicated' MTA tax and had already been collected by the State." In other words, the state didn't pass onto the MTA the dedicated transit taxes it had collected.
The dedicated revenue source in question -- the Metropolitan Mass Transportation Operating Assistance Fund (MMTOA) -- was established in 1981 and consists entirely of taxes collected in the 12-county MTA region. (A report released by the New York City comptroller in 2008 [PDF] lays out some of the history behind Albany's declining contribution to MMTOA.) So $118 million in downstate taxes, meant to fund transit exclusively, disappeared into the Albany money pit. Nothing in New York state law prevents the same thing from happening again.
What does it mean going forward? New transit funding would be great. But transit riders must also protect the transit funding we already have. Albany faces enormous budget gaps and is desperate to fund politically potent programs like education and Medicaid. Transit riders should beware attempts to steal more money from dedicated transit funds.

Dodd Vows to Pass Livability Bill Amid Skepticism From Rural Senators [Streetsblog New York City]
Even as the Obama administration ramps up its work on a sustainability initiative that treats transportation, housing, and energy efficiency as interconnected aspects of development policy, the effort remains without an official congressional authorization -- a situation that Senate Banking Committee Chairman Chris Dodd (D-CT) vowed to fix yesterday.

Dodd, whose panel has jurisdiction over housing and urban development, is working with that 10-month deadline as he anticipates retiring from Congress at year's end. His push to create a long-term foundation for the administration's sustainability effort also could run into resistance from rural lawmakers whose states have tended to benefit from a transportation spending system based on road-mile formulas.
The first stirrings of rural skepticism came on Thursday, when Sen. Mark Begich (D-AK) questioned the administration's move to emphasize "multi-modal" transport projects that would combine roads, transit, and bike-ped access.
Begich asked the U.S. DOT's No. 2, John Porcari, to make sure that rural states are "not lost in the mix." That sentiment was echoed later in the day by Sen. John Thune (R-SD).
"It seems to me that [the Office of Livable Communities] is a program that's going to overwhelmingly focus on urban areas," Thune told Porcari during the latter's appearance before the Senate Commerce Committee, asking if rural states such as his own would "get some assurance or guarantee of funding."
Porcari assured the senators that the administration plans to include rural areas in its sustainability plans, describing the program as an opportunity to restore the "quality of life" once associated with small-town America. Nonetheless, the concerns raised by Begich and Thune could signal more requests for livable communities grants to be distributed among all states, as opposed to the more competitive process the administration has outlined for its first $150 million of funding.
The most significant test of Dodd's ability to marshal support for his bill authorizing the livable communities office may come later this spring, as lawmakers consider the administration's request for about $530 million in 2011 funding for the effort. Congress assented to the White House budget request for $150 million in sustainability grants for 2010.

DOT Commissioner Janette Sadik-Khan appeared on WNYC's Brian Lehrer Show last Wednesday to talk about the agency's plans to, as Lehrer put it, "spread the Times Square model." When Lehrer invited listeners to call in with their ideas for other streets that should be made car-free zones, "Steve from Manhattan" asked why the Central Park loop wasn't being closed to traffic, calling it "obvious" and a "no-brainer." In her response, the commissioner said that Central Park's loop road already is closed to traffic "98 percent of the time."
Photo: bicyclesonly/FlickrIf this were true, it would invite the question why it's such a big deal to finish the job, but in fact Sadik-Khan's statistic is simply false. Worse, she's clearly been using this inaccurate figure for quite some time, because she also cited it in a conversation I had with her back in October 2008.
Here are the facts: Because different sections of the loop are open to traffic for different lengths of time, the actual percentage depends on where you are on the loop and also on what you define as "the time" (for example, is it every hour of every day or only the hours when people are actually in the park?). Given this, the actual percentage of time that cars are banned ranges from a low of 44 percent to a high of 94 percent, depending where you are on the loop.
Let's assume that "the time" means every hour of every day. With the West Drive now open to traffic for only two hours on weekday mornings, it's closed to traffic 94 percent of "the time," which is the likely source of Sadik-Khan's "98 percent." But as any recreational user of Central Park knows, the six-mile loop has an East Drive as well, which is open to traffic far longer. The East Drive north of 72nd Street is open from 3 p.m. to 7 p.m., and the half-mile segment between the Sixth Avenue entrance and the E. 72nd Street exit permits vehicular access from morning until night, 10 a.m. to 7 p.m. This means the section north of 72nd is closed to traffic 88 percent of "the time" and the southern section is closed only 73 percent of "the time."
The percentage of car-free time drops if we limit "the time" to weekday hours when people are actually likely to be in the park, and exclude weekends (when cars have been banned for 43 years), the overnight curfew (when no one is allowed in the park anyway), and the period from 10 p.m. to the curfews' start at 1 a.m. If "the time" is instead defined as weekdays from 6 a.m. to 10 p.m., the West Drive is closed to traffic 87 percent of the time, the northern part of the East Drive is closed 77 percent of the time, and the southern section is closed less than half the time (44 percent).
Whatever the percentages are, the fact remains that the drives are open to traffic during the precise hours when recreational use is highest: before the start of the workday on the West Drive; when kids are getting out of school and adults off from work on the northern section of the East Drive; and virtually all day on the East Drive's southern corner. The commissioner's implicit assertion that the park is almost completely closed to traffic is highly misleading and unhelpful.
On the more hopeful side, Sadik-Khan told Lehrer that closing the park to cars is "something we've been looking at," but she hastened to add that "it's a balancing act in terms of understanding how the traffic flows through this important part of the city."
One wonders how much more data DOT needs before its understanding is complete. Over the past two decades the agency has repeatedly installed traffic counters both in the park and on surrounding streets. After each of its major adjustments to car access it has conducted detailed studies, none of which found any significant traffic problems. Isn't it time DOT heeded the advice that urbanist Jane Jacobs offered me in a letter from 2002?
[soft link]We had the same sort of fight in Washington Square Park in the late 1950s and in my neighborhood here in Toronto a couple of years ago: same prediction of traffic chaos, same result of no chaos, diminished traffic counts and no counts increased elsewhere in consequence. Isn't it curious that traffic engineers are so loath to learn something new even after repeated demonstrations? Both in Washington Square Park and in my Toronto neighborhood we got our way by pressing for an experimental trial period. A trial, with traffic counts on the Central Park perimeter streets, will be more persuasive than any amount of talk, letter-writing, resolutions, and other endless wheel-spinning.

Using Social Media to Fix Transit That Fails [Streetsblog New York City]
At Streetsblog Network member blog Planning Pool, this week is being billed as "Fail Week" --a full five days on "information about bad planning, lack of planning, and planning generally gone awry." We can't wait to see what they'll be doing. There's certainly no shortage of potential topics.
Their first fail-related post actually has to do with a success of sorts -- the use of Twitter to highlight problems in transit:
One of the more complicated aspects of Twitter are hashtags. Hashtags are words preceded by the hash symbol, #, like #transitFAIL. The purpose of a hashtag is to organize information and people. They are often used to Tweet about current events, conferences, quotes, activities, memes, and other things. Mashable has a good explanation about how they work.…
One of my favorite planning-related hashtags is #transitFAIL. The purpose of #transitFAIL is to publicize where public transportation fails its customers and users. It’s a particularly effective tool, because you can use SMS messaging or use a web-enabled smartphone to instantaneously tell the world about how transit just let you down. Some smartphones can even take photos or videos and upload them to Twitter, too.
Smart transit providers will use this feedback to improve their service and see where the problems are. I’d like to see transit providers use Twitter to notify people about service changes or delays, too.
I didn't know about the #transitFAIL hashtag, but it's a good idea (we actually used "transitfail" as a tag in Flickr when we were putting together this user-generated slide show on lousy transit). Some transit agencies are using Twitter for service delays as well -- @NYCTSubwayScoop is an example. Will this ever evolve into standard practice? Should it? Or is the reach too narrow?

This time-lapse film by Tracy Collins at Not Another F*cking Blog is a telling indictment of poor pedestrian conditions at Atlantic and Flatbush Avenues. And depending on how Bruce Ratner's new sports arena is built out -- the groundbreaking is set for this week -- things could get much worse.
As exemplified by the crosswalk hogs in the video, this is a terrible environment for pedestrians right now. If and when the arena arrives, two things will happen: thousands of pedestrians will arrive via transit to get to games -- the more the better, but they'll need more space; and more people will be driving here, especially if there's a huge surface parking lot.

It's both a stark admonishment of how much we've given up for the car, sometimes barely noticing it, and a heartening reminder that what often seems normal to us need not be:
[soft link]We are visitors to the States from England. Our main reason for coming was to visit friends, however upon researching into transport options we were horrified to discover that the only viable option to get from NY to LA via many small towns was by car. Many of our friends have tried to justify this saying that 'America is simply too big to have public transport'. To us, this is purely INSANE. Surely a huge country should offer the best public transport in the world! Bullet trains could cover the driving distances in no time.
We are feeling quite ashamed of ourselves as we write this but inevitably we did end up driving across America. We have found the American people to be welcoming and friendly and the landscape beautiful but we have not yet seen a single 'town' in the US that we, as Europeans would class as a town. I would class them more as motorway service stations. Buildings designed for cars. People waiting in line for a drive through. People competing for car parking spaces at gyms! These are not communities as we would recognise - market squares, parks, rivers, cafes, stations, public art, gardens etc. 'Towns' are simply not towns! We feel saddened that many Americans are not afforded the community lifestyle that we enjoy in Europe.

Bus Cams on the Table in Gov’s Budget [Streetsblog New York City]
If New York were allowed to install bus lane enforcement cams, bus riders wouldn't be slowed so much by illegally parked delivery trucks.New York can't install bus lane cameras without authorization from Albany. So far, the legislature hasn't bestowed it, despite wide-ranging support. Two years ago, Assembly transportation commmittee chair David Gantt killed an earlier version of bus camera legislation, leaving New York City bus riders stuck in traffic.
The new budget amendment would actually be an improvement over that bill. The old legislation limited bus-mounted cameras to the city's five Select Bus Service routes, while the current version allows camera enforcement on up to 50 miles of bus routes -- exactly the length of the city's current bus lane network. "It's saying that all bus lanes are important, in every borough," said Lindsey Lusher Shute, Transportation Alternatives' director of environmental campaigns.
The cameras would either be stationary or mounted on buses, recording the license plates of motorists parked or driving in bus lanes. Fines would be set at a maximum of $125.
Camera enforcement would be a real game-changer for bus riders. Dedicated lanes can mean much faster trips, but in New York, all sorts of other vehicles constantly violate bus lanes. Manhattan Borough President Scott Stringer's office conducted a study last summer which found more than 350 vehicles parked in Midtown bus lanes over a 40 hour period. The police, meanwhile, are at best too thinly stretched to spend sufficient manpower on keeping bus lanes clear, and at worst they're the source of the problem.
Because NYCDOT and the MTA appear loath to install physically separated lanes for their big-ticket bus improvements on First and Second Avenues, camera enforcement will be critical to achieving better performance.
"The most effective way to provide faster and more reliable bus service is to enforce bus lanes by cameras," said Gene Russianoff of the Straphangers Campaign. "Sporadic and limited ticketing by police just doesn't keep bus lanes moving, free of illegally stopped cars."
For the bus camera legislation to emerge intact from the budget process, both the Assembly and the State Senate will also need to include it in their budgets, which are expected to be released in about three weeks. The Senate is fairly likely to include bus cameras in its budget, said Shute, so the question is whether Gantt will keep it in the Assembly version.
If not, bus camera legislation would
have to be passed as a stand-alone bill. Assembly Member Jonathan Bing
is already sponsoring one such bill. Advocates will be in Albany on
Wednesday, making the case for cameras.

- Wednesday: Manhattan CB 3 will hear a presentation on SBS before turning to LES bike routes. 6:30 p.m.
- Thursday: The SBS presentation to CB 8, snowed out last month, is on for 6:30 p.m. (There may be dueling Upper East Side SBS events Thursday. According to NYCDOT's website there will be an SBS open house just a few blocks away starting at 6 p.m. However, NYMTC has indicated this may have been postponed until later in the month.)
- Friday: Time's Up's new Bureau Of Organized Bikelane Safety (B*O*O*B*S) Team has moved up its inaugural ride to this week. 12 noon Friday.
- Saturday: More group action with the Ides -- make that Pies -- of March Ride, the perfect time for the Bike Lane Liberation Clown Brigade. 2 p.m.

The writer of this Streetsblog Network member blog, a resident of Charlotte, North Carolina, is not actually totally car-free, but he has made a commitment to commuting by bike or bus for the calendar year of 2010. From his introductory post:
It’s important to understand I am an average Joe, in my thirties, working a 9-5 desk job. I have a wife and a one-year-old son. I live in an average-size city with an average public transportation infrastructure, and I live seven miles from the city center. My wife is not a zealous bicyclist, and truthfully, not very supportive of this project! My wife does own a car and I will probably occasionally drive it with my family in the car. I am not an anti-car zealot, but what I want to highlight are the challenges and choices I will face in my everyday life and the impact they will have on me as I live this (sadly) "alternative lifestyle." I am choosing not to transport myself individually in a vehicle designed to fit five. It’s ludicrous, and we all have grown numb to the impact we have on our communities, on our countrymen and women, and on the world. If I can do it, there are millions of other people in this country who can do the same thing, and that’s the story I plan to tell.
He's now tallied the results of the first two months of car-free life, and they're pretty impressive:
In January and February I commuted by bicycle or bus a total of 36 days or 72 trips, not counting holidays and vacation days. Of those 72 trips I took the bus 32 times. February was a really cold, wet, and snowy month in Charlotte so I took the bus a lot in February.…
In two months I have had the following impact:
- I’ve saved $47 in gasoline expenses and the equivalent of $457 in fixed costs for a total savings of $471.49 when accounting for bus costs.
- Burned 22,356 calories which if I had been eating a normal diet is the equivalent of 6.4 pounds of fat!
- I have kept 543 pounds of carbon dioxide out of the atmosphere (19.546 lbs per gallon and my car gets an average of 21 MPG).
Simply multiplying these numbers for the year would equal 3,260 pounds of CO2 kept out of the atmosphere, $2,542 dollars saved, 134,000 calories burned, and 38.3 pounds of fat. If I had a car loan payment for a $20,000, the savings jumps to $7,900!
I knew I was benefiting myself and the environment by commuting without a car, but to see the real impact is very amazing. These numbers don’t take into account the savings because of improved emotional and physical well being I am getting because of the exercise. They also don’t take into account the benefit to my community from interacting with my neighbors and fellow commuters. These numbers don’t measure the impact of the 40,000 people every year who’s lives are cut short because of car crashes. These are dry,raw, facts, and figures, but if you consider how these facts scale year over year for an individual, or scale for the United State, if just 5% of the people who commute by car switched to walking, bicycling, or public transit, the numbers would be astounding.

The Manhattan Bridge officially opened on December 31, 1909. While its 100-year anniversary came and went with little fanfare a few months ago, city officials paid respects today.
At the ceremony, Clarence caught up with Gridlock Sam Schwartz, who heads the NYC Bridge Centennial Commission. In this clip Schwartz describes the nearly catastrophic deterioration of the bridge, which prompted a massive rehab that began in the 1980s and is just now concluding.

Building an App to Help Neighbors Ride Together [Streetsblog New York City]
Of all the ways to improve your bike commute, riding with a friend might be the simplest. Not only do you have someone to talk to at red lights, you also become more visible and therefore more safe. With that in mind, Transportation Alternatives is working on a new tech solution called Bike Buddy to help New Yorkers find someone to ride with.
The idea is to combine online mapping software with social networking -- Ride the City meets Facebook. You'd plug in your starting point and destination, and the software would show you the best route to take and recommend a partner to ride with. "Ride the City gives routes to cyclists and lets them choose a safer or a more direct route," said Caroline Samponaro, TA's bike director, but she wants to "beef it up and make it more exciting for people." Helping neighbors bike together could be that killer app.
New York State currently runs a carpooling website, CommuterLink, that offers some bike-pooling assistance, said Samponaro. Bike Buddy would draw on TA and Ride the City's better understanding of bike culture. "Biking is so inherently social," said Samponaro, and Bike Buddy would build off that.
TA is still in the early stages of developing Bike Buddy. If the app goes live, Samponaro expects it to spread across the country. Cycling activists in cities across America have already expressed their interest, and TA says Bike Buddy can succeed as a national website.

Photo: TAIt is rare that in the course of pedaling from point A to point B -- starting out in a good mood, minding my own business, obeying the rules -- that a motorist isn’t rude or downright dangerous toward me. I take it personally. After all, wouldn’t anyone smaller and less protected feel frightened as well as dissed? And since I am more of the “fight’ than “flight” kind of gal, I have to get a grip -- a tight one, or I will put myself in the very danger that I am trying to avoid.
I recently met a couple of guys who are taking my problem (perhaps "our" problem) to heart, and putting some creative energy into a solution.
Dear Driver, the brainchild of Erik Fabian and Josh Weinstein, is a combination self-regulation tool and cyclist/driver communication conduit. Like many good ideas, it isn’t complicated.
It works like this. You cut me off, almost door me, or yell at me for taking street space, and I take a deep breath and hand you a nicely printed letter for you to read when you park your vehicle.
What does it say? Essentially: that I felt endangered, and that I hope you will take a moment to read a brief note that helps you understand who I am (a woman of a certain age, a psychotherapist), why I bike (I love it and its non environmental-impact), the challenge for me on two wheels (particularly since 2006 when my husband, Dr. Carl Henry Nacht, was killed on his bicycle), and what the rules of the road are for us both.
My letter then invites a response at the website where the driver might become even more enlightened about city cycling. Whose Lifestyle Is It Anyway? [Streetsblog New York City]
As malls have struggled over the last 20 years or so to stay culturally relevant -- or even profitable -- one of the solutions that has gained ground is the "lifestyle center." These are malls with sidewalks and sidewalk musicians, European-style fountains, open-air restaurants, and of course, lots of shopping. They are prefab places masquerading as real places. Check out this 2006 piece from Slate and you'll get the idea.
Some might ask, What's so terrible about that? After all, these neo-malls take a lot of their design points straight from the new urbanist playbook. They recognize the human desire to walk in a safe environment and interact with other humans. They bank on the idea that people hunger for the connection of street life.
Well, as Streetsblog Network member Extraordinary Observations discovered on a recent trip to Cleveland's Orwellian-sounding Legacy Village, there's one major hitch: It's impossible or unsafe to approach most lifestyle centers without a car. Which is why the blog's author, Rob Pitingolo, calls his post, "Not My Lifestyle Kind of Center":
Earlier this week I took my bike and rode over to Legacy Village, one of two "lifestyle centers" in suburban Cleveland.… Every previous visit I made, I came and went like 99% of the visitors: by driving in a car and parking in the ginormous "free" surface parking lot. There are two primary entrances to the center. One on Cedar Road and one on Richmond Road. There is a perimeter road with 25 mph speed limit signs, but the streets were designed to handle traffic moving at speeds well exceeding 25. Many drivers ignore the speed limit, and why shouldn't they? The designers built the perimeter road so that they would feel safe flying around every curve.…
[T]he heated sidewalks inside the center were salted, dried and cleared so that no "pedestrian" would have any trouble moving from store to store. But the sidewalk right outside the center on Cedar Road, the street that I carried my bike along to get to the center, was covered in a foot of week-old snow. No salt. No plow. Nothing. The street itself was clear and dry. Cars sped by at 40mph.
Legacy Village is surrounded by an ocean of free parking spaces, but bike parking spaces are few and far between. I couldn't find a rack near my destination on the main "courtyard," although I was told after the fact that there is a rack somewhere near the Apple store. I locked my bike to a fence and on top of about a half-foot of snow.
In the end, the question in my mind was, what kind of "lifestyle" does the center attract? It's ironic that in order to be a pedestrian inside its borders, it's essentially a prerequisite that you must be a motorist to get there. It's convincing evidence that if what we want is density and walkability, the solution doesn't come prepackaged in some faux village on the outskirts of a city. We had real towns, villages and cities in this country for most of its history. And we destroyed them and replaced it with this? That's sad. Really sad.

To Save Student MetroCards, Trim the Fat From Bloated Yellow Bus Costs [Streetsblog New York City]

New York City's MTA hearings wrap up tonight at the Fashion Institute of Technology in Manhattan. If experience is any guide, we'll get to watch a parade of pols harangue the MTA Board without offering much in the way of solutions for the underlying financial problems plaguing transit.
But if our elected officials really want to stick up for their constituents, maybe one of them will mention these numbers on student transportation in New York City. As Noah reported Monday, taxpayer support for student transit passes -- which move nearly 600,000 NYC schoolkids -- pales beside the huge outlay for yellow school buses, which transport about 150,000 students. The state and city literally spend pennies per trip on student MetroCards, while the Department of Education's billion-dollar budget for yellow buses works out to about $19 for every student trip.
The long-term trend shows that school bus costs are, quite simply, out of control:

LaHood Faces Off With GOP Senator Over High-Speed Rail, Livability [Streetsblog New York City]
When Cabinet secretaries appear in front of Congress' appropriations committees, which control the annual budgets for each federal agency, the proceedings tend to be dry affairs dominated by local concerns and arcane fiscal debates.
Sen. Kit Bond (R-MO) (Photo: Politico)But Transportation Secretary Ray LaHood's visit with Senate appropriators today was anything but humdrum, as Sen. Kit Bond (R-MO) challenged him repeatedly to defend the White House's efforts on sustainable development and high-speed rail.
Bond cited a recent Wall Street Journal editorial by Wendell Cox, a conservative pundit who has penned laudatory literature for road lobbying groups, in accusing the Obama administration of frittering away taxpayers' money on high-speed rail.
LaHood fired back, remarking wryly that Bond's home state sought high-speed rail grants and publicly celebrated its $31 million haul. "I got calls on this every day from senators and governors" clamoring for an opportunity to build inter-city passenger rail, LaHood said.
Answering Bond's charge that the rail funding process was less than transparent, the U.S. DOT chief threw in a bold claim: "I don't know of one lobbyist that darkened our door with an application … that came to our door with the idea they were going to have some edge."
A November investigation by the nonpartisan Center for Public Integrity found that more than 50 government entities and private companies have hired high-speed rail lobbyists, including the AFL-CIO, the Mayo Clinic, and overseas train manufacturers such as Siemens and Bombardier.
The sharpest exchange between Bond and LaHood came on the topic of walkable local development, which the U.S. DOT has worked to promote through $150 million in 2010 grants and an inter-agency partnership with housing and environmental protection officials.
"What is livability?" Bond asked LaHood, minutes after comparing the task of defining the term to defining pornography. (The origins of that reference are explained here.)
"Communities where people have access to many different forms of transportation, and affordable housing... maybe they don't want a car, so they can walk to work or take mass transit to work," LaHood said, using the newly built-up neighborhood surrounding his office as an example.
Bond's reply summed up the challenge of crafting new federal transportation policy in an era marked by rural-urban-suburban culture clashes. "I've got a lot of constituents for whom livability means having a decent highway," he said. "They've got to drive between one town and another town."
LaHood gamely tried to put Bond's criticism in perspective, noting that highways received the lion's share -- $27 billion -- of the transportation funding in last year's economic stimulus law.
Yet Bond only dug in his heels, arguing that Americans had shown their eagerness to use roads and bridges but would not embrace rail or walkable infrastructure. "When did it become the responsibility of the federal DOT to
build sidewalks?" the soon-to-retire senator asked, before LaHood that reminded him Congress set up dedicated funding for pedestrian improvements nearly 20 years ago.

Photo: Daily NewsFollowing two incidents late last year in which off-duty cops killed pedestrians, then refused to submit to Breathalyzer tests, Commissioner Ray Kelly worked with city district attorneys to expedite the collection of blood evidence from motorists arrested on suspicion of driving drunk. But as civil service newsweekly The Chief-Leader reported after the deaths of Vionique Valnord and Drana Nikac, Kelly has yet to match the department's zero tolerance drug abuse policy with one that addresses cops who drink and drive.
The paper speculates that Kelly's inaction may stem from drinking as an accepted facet of cop culture, despite the fact that driving drunk can be at least as harmful as the use of illegal drugs:
[W]hile it's legal to drink, it isn't to then drive when under the influence. And those who do so are committing at least as serious a crime as those who use cocaine or heroin; in some cases more so, since the NYPD's one-strike-and-you're-out drug policy makes no distinction between those who abuse them without leaving their homes but come up dirty on a subsequent test and those who are out in the street presenting a potential menace whether behind the wheel or not.

The New Domino development proposed for the Williamsburg waterfront made headlines last week when a Brooklyn Community Board 1 committee voted against enabling its construction. This privately financed project is worth a close look because it exemplifies how developers can embrace certain livable streets goals while ignoring the big picture of traffic. It's the kind of development the city will have to guide with a firmer hand in order to meet the sustainability goals of PlaNYC.

Image: The New Domino.The New Domino's 2,200 residences would transform 11.2 acres just north of the Williamsburg Bridge, at a former sugar refinery about three-quarters of a mile from the two nearest subway stations. It fronts the Kent Avenue bike lane and the future path of the Brooklyn Waterfront Greenway. At a site so large and so integral to the city's bike network, but with mediocre transit access, the developer's transportation decisions are critically important.
Determining how much parking to construct is one such transportation decision, and on that score the New Domino abandons good planning.
The development's 1,694 off-street parking spaces would bring a flood of new motorists to Williamsburg. This is, in a way, intentional. The developer is attempting to match current car ownership rates in the area, according to Martin Hopp, who's overseeing the project design for Rafael Viñoly Architects. "We felt that it was important to accommodate the anticipated parking need on-site," said Hopp, "rather than to substantially increase vehicles circling the neighborhood for the already limited on-street spaces."
Building so many parking spaces will induce New Domino residents to drive. Research indicates that free parking spaces at home encourage New Yorkers to commute by car. "The amount of parking infrastructure to provide should be based on the neighborhood's and the city's street capacity, the city's goals in terms of carbon reduction, traffic flow, pedestrian safety and so forth," said UPenn professor Rachel Weinberger, co-author of the study "Guaranteed Parking -- Guaranteed Driving" [PDF]. "Deciding how many parking spaces to provide on the basis of what is profitable and/or on the rate of car ownership in the surrounding area is completely inappropriate and represents the city's abdication of its responsibility to protect the public health and welfare."
The expense of building underground parking spaces will cost the developer between $30,000 and $50,000 per space, according to Columbia planning professor David King. That means reducing parking would free up quite a lot of money, which could be spent instead on transit improvements. King recommended that New Domino provide shuttle buses to the subway, a practice that he said is common in Riverdale and some nearby suburbs, and that the developer construct less parking. "It's certainly worrisome that all this parking is being supplied," said King. "That's 1,700 cars and it's going to really overwhelm the community; there's no doubt about that."
Usually developers face pressure from local residents to provide parking for new arrivals, but in this case, some locals oppose the addition of so much storage for vehicles in
their neighborhood. "It's interesting because they say
they're going for LEED certification, they're going for green roofs,"
said Lacey Tauber of Neighbors Allied for Good Growth, a local advocacy group which has criticized parts of the New Domino plan. Her organization is calling for the developer to pare down the number of parking spaces to the
city's required minimum -- 1,042 spots -- and to work with the MTA on providing more transit
options.

Tauber credits the developer for including significant ground-floor retail in its plans. Between the retail and the waterfront access, she said, "it will be very pedestrian friendly once the construction is done." Tauber also sees the New Domino's bike infrastructure as sufficient, noting that "they're pretty supportive" of local cyclists. Those improvements will include public bike racks outside and bike storage and changing rooms inside.
The developers of New Domino want to make their 11 acres an attractive place to walk and bike. But they also want to build nearly 1,700 parking spaces that will generate traffic and encroach upon pedestrians and cyclists. It's a contradiction that could be resolved if the city aligns its parking policy with urban design and sustainability goals. "For most U.S. cities simply doing away with parking minimums is a good first step in parking reform," said Weinberger. "For NYC it's imperative that the city think about parking maximums."

In the meantime, artists and designers are invited to submit ideas for "economical, temporary surface treatments" to serve the needs of the 350,000 pedestrians who pass through Times Square every day. The winner will be selected by representatives from DOT, the Times Square Alliance, Mayor Bloomberg's office, and the Design Commission along with "one outside artist or arts advisor."
The winning design will fetch $15,000. Deadline is April 16.

Rising to the Challenge of Bringing Kids on Transit [Streetsblog New York City]
Following up on yesterday's post about family-friendly transit, which generated a raft of interesting comments on Streetsblog New York (and even more on our SF, DC and LA sites), we've got a dispatch from the front lines. Carla Saulter, who writes the always excellent Bus Chick blog out in Seattle, weighs in on how going from one kid to two has made her car-free existence significantly more challenging, although she remains characteristically undaunted:
The second time I rode the bus with both babies…I was parenting solo, and, thanks to a morning errand in the neighborhood, arrived at the 48 stop mere seconds before the bus did. While I squatted on the sidewalk, trying to un-jam the stroller -- with one hand on the baby (to prevent him from tipping out of the sling-like carrier he's riding in until he gets big enough for the real deal) and one hand on Chicklet (to prevent her from running into the busy street we were waiting near) -- the bus pulled up, and folks started boarding. When they finished, I was still struggling.
The driver peered out the door and asked politely, "Are y'all coming?" but I was so embarrassed and discombobulated, I shook my head.
"I'll just catch the next one," I said, and then watched as he closed the doors and drove away.
The three of us did, in fact, wait the 15+ minutes for the next bus… By the time we finally made it to the park, I was stressed and tired, and we were late to meet our friends.
Carla's experience is certainly familiar to me. I've been the woman squatting on the sidewalk trying to fold the stroller and finally telling the bus to move on. There's no doubt that designing transit vehicles to accommodate strollers would make things a lot easier for parents, as several commenters noted yesterday.
Still, I think attitude has a lot to do with it as well. In my case, my own childhood experience of using transit rather than cars definitely played a factor. The first couple of years of my son's life in Brooklyn, we actually did own a car, but we only drove it when we were leaving town (and we happily gave it up years ago). When I was growing up in New York, it was just common wisdom that driving within the city was frustrating, slow, expensive and scary. I'm not sure when that perception changed, but it seems that it has. Many of the families I know today, even in Manhattan and Brooklyn neighborhoods where traveling by transit or foot is genuinely easy, now choose to drive.
My son's whole life -- he is now nearly eight -- we have done almost all our trips by transit, foot and bike. Sometimes we catch a ride with a friend, but he often prefers to walk. Every now and then we use a car service or cab. Once or twice a year we rent a Zipcar. On plenty of occasions, we have experienced a smoother, more enjoyable trip to our destination than friends who have traveled the same route by car.
The converse is occasionally true as well. But all in all, I have to agree with Carla when she says, "There are certainly challenges, but every choice comes with challenges, and I'll take mine over all of the drawbacks of driving."

Senate Starts Work on New Transport Bill, With House Version as a Guide [Streetsblog New York City]
The Senate today took its first steps towards voting on a new long-term federal transportation bill, with environment committee chairman Barbara Boxer (D-CA) vowing to take up a successor to the 2005 infrastructure law before 2011 and indicating she would use the House's already-introduced version as a framework.

(Photo: Politico)Such willingness to consider a new infrastructure bill before the Obama administration's preferred timeframe of next spring could help thaw the frosty relations between Boxer's panel and the House transportation committee, where chairman Jim Oberstar (D-MN) has raged against upper-chamber inaction for months.
But lawmakers and industry lobbies have a long way to go before they can sing from the same hymnal on the next transportation bill. Boxer asked representatives of the four lobbies appearing today -- the American Association of State Highway and Transportation Officials (AASHTO), the American Road and Transportation Builders Association (ARTBA), the National Construction Alliance (NCA) and the Associated General Contractors (AGC) -- to parse Oberstar's bill "literally, with a pen" and let senators know which provisions they favored or disliked.
"We're going to take their bill and work from it," Boxer said of the House, which has proposed a $500 billion plan that streamlines 108 categories of formula-based federal transportation spending into four and includes dedicated funding for metropolitan area priorities.
Neither the transit industry nor transportation reform advocacy groups had a representative at the hearing. The four witnesses largely limited their comments to the economic need for a new long-term federal bill, with former AASHTO president Pete Rahn endorsing the price tag of the House bill but suggesting that he viewed it as overly solicitous to transit.
"We need a balanced bill that increases funding for both highways and transit," said Rahn, who leads the Missouri state DOT.
And though the biggest stumbling block facing the next federal transport bill -- namely, the lack of sufficient gas tax revenue to pay for it -- was lamented widely, few offered concrete solutions that would help Congress move forward more quickly.
"The problem we have in infrastructure is not ways to borrow more money," Rahn replied to a question about Build America Bonds, a successful if occasionally controversial infrastructure financing tool established in last year's stimulus law. "We need to find a way to pay for improvements ... We've now topped out the credit card."
Rahn urged lawmakers to address the declining utility of the gas tax, pointing to a "conflict" between its continued role as Washington's transportation revenue-raiser and the growing acknowledgment that oil consumption needs to decrease for environmental and national security reasons.
Griffith Company president Tom Foss, speaking for the AGC, said that industry groups are open to other options, such as increased tolling or an eventual transition to a vehicle miles traveled (VMT) tax. Still, he added, "the gas tax is still best way to fund" federal transportation law because "we can advertise [it] to the general population."
The hearing took place as the House prepares to vote as soon as tomorrow on a $15 billion jobs bill, already cleared by the Senate, that would extend the 2005 transport law until year's end. Boxer and fellow senators asked the witnesses to underscore the importance of that 10-month extension in conversations with the House, where some Democrats remain reluctant to embrace the upper chamber's jobs package.

MTA Blame Game: Lowlights From Queens [Streetsblog New York City]
The MTA roadshow is in full swing, with raucous public hearings on service cuts drawing hundreds in Queens and Staten Island last night. Some press outlets are questioning whether the hearings actually get anything accomplished. It's a good question to chew on, since the MTA Board's options are limited by the agency's massive budget gap.
Assembly Member José Peralta is running for Hiram Monserrate's State Senate seat on a transit platform the Fare Hike Four would approve of.New York's state legislators have played an especially critical role in the transit funding crisis. In the last two years alone, the legislature has foiled two potential revenue streams for transit, congestion pricing and bridge tolls. The solution Albany could muster -- a regional payroll tax -- has come up far short of expectations. Then the state stole $143 million from the MTA in December to balance its own budget problems. Neither the state nor the city has kept up its share of funding for student MetroCard costs.
Our elected officials are the ones with the most power to help fund the MTA and avert drastic cuts, or at least put a fix on the agenda. Here's a sampling of what they said at the hearing in Queens last night.
Assembly Member José Peralta is currently running to replace Hiram Monserrate in the State Senate. Transit riders would be hard-pressed to do worse than bridge toll foe Monserrate, but they might have no choice. Peralta's campaign website touts his opposition to congestion pricing, and he was a particularly vocal opponent of tolls on the East River bridges.
Last night, Peralta missed no opportunity to land a blow against the MTA -- telling the board "some of you aren't even paying attention" was the applause line of the night. "You have my word as a state legislator that we will continue to fight this," Peralta promised the crowd. His solution? Give the state more control over the MTA -- an idea that should draw grimaces from anyone familiar with Albany's recent history of governance.
Plenty of other electeds used their three minutes at the microphone exclusively to attack the MTA. None of these pols mentioned the role their legislative houses played in the MTA's fiscal crisis. Some choice excerpts:
- Assembly Member Grace Meng berated the MTA for cutting student MetroCards, telling the board that students "should expect that we've made a serious investment in their education." Of course, the state legislature where Meng serves has led the way in slashing the investment in student transport.
- A rep from State Senator Shirley Huntley's office argued that previous fare hikes should provide enough funding to withstand the financial battering brought on by the recession and years of legislative neglect.
- City Council Member Elizabeth Crowley told the board that unless the MTA "eliminates its most wasteful spending," kids will be hitchhiking to school.
- Council Member Karen Koslowitz's representative attacked the "years of mismanagement" at the MTA.
- Council Member Leroy Comrie, who voted against congestion pricing, focused on the MTA's proposed layoffs: "You're creating more unemployment."
- Another congestion pricing foe, Council Member Peter Vallone Jr., mustered the most indignant attack of the evening -- and was rewarded with a nice chunk of screen time on the Fox 5 11 o'clock news. "How dare you take our trains, take our buses, take our student MetroCards, while at the same time giving raises and giving friends and family free rides?” he asked. "How dare you?" Later on, in a moment that didn't make it into the Fox 5 segment, Vallone at least had the good sense to blame Albany as well, unlike many of his colleagues.
Many officials didn't scapegoat the MTA directly, but neither did they offer anything resembling a constructive solution. Queens Borough President Helen Marshall, who opened the evening, typified this approach. "At a time when we are encouraging mass transit," said Marshall, "we shouldn't be cutting eight bus routes." Instead, she said, Queens need more from the MTA: new local and express buses, reopened LIRR stations, longer subway platforms, more ferry service. How to fund it all? "There has got to be a way," was all Marshall could offer.
Assembly Members Audrey Pfeffer and Karen Nolas and Council Member Jimmy Van Bramer all expressed their desire to keep New York City transit strong, without offering a way to either cut spending or raise revenue.
Others, notably City Council Speaker Christine Quinn and transportation committee chair Jimmy Vacca, endorsed the Straphangers Campaign plan to redirect $140 million in flexible funding from the MTA's capital budget to its operating budget. While Quinn claims that the plan is enough to eliminate the cuts to Access-a-Ride, student MetroCards, and the worst cuts to subway and bus service, it's hard to see how a one-shot stimulus fix can stretch that far, let alone address the structural budget problems that are plaguing transit.
Only a few officials put responsibility in the right place or offered real prescriptions for maintaining transit service. "The city and state should not cut student fares," said Council Member Peter Koo at a rally outside the hearing. Surprisingly, Assembly Member David Weprin -- a leading congestion pricing foe as a member of City Council -- not only called for additional funding from the city, state, and feds, but said that he supported the Ravitch Commission's plan to generate more revenue, which included bridge tolls.
Of the electeds, no one emphasized the need for new revenue streams as directly as Manhattan Borough President Scott Stringer. "I didn't come here just to criticize the MTA for proposed service cuts and fare hikes," he said. "We need to find a way to make it financially viable." Stringer did not mention congestion pricing or bridge tolls, however, calling instead for Albany to reinstate the commuter tax, which he claimed would raise $500 million for the MTA.
Unlike many of their representatives, the students who gathered outside the hearing avoided attacks on the easy MTA target. The high schoolers held signs with pictures of the governor and mayor. "We're focusing our attention on Mayor Bloomberg," said Kevin Kang, one of the student activists, "because he's in charge of the whole education system. He needs to step it up so that whether the MTA funds [student MetroCards] or not, it gets resolved."

Right now, Seattle is making as serious a commitment to transit as any city in the nation. Recently, Streetfilms got to take a tour of the newest addition to the city's network -- the 13-station Link Light Rail, which opened in mid-2009.
The route is beautiful, swift, and has great multi-modal connections. Service is frequent, with headways as short as 7 minutes during rush hour, and never longer than 15 minutes. And like many of the newest American light rail systems, the stations feature copious art.
Seattle has a lot of car commuters, but in a sign that many are looking for more efficient and environmentally friendly ways of getting to work, the new light rail line will be followed by several more additions to the city's transit network. As Seattle's Sound Transit CEO Joni Earl told us:
[Voters] in November 2008, by 57 percent -- which was a thrill in a recession economy -- voted to expand our light rail system, and our commuter rail system, and our buses... to add another 36 miles of light rail in the region. And to add 65 percent more capacity to our commuter rail system.

The Importance of Family-Friendly Transit [Streetsblog New York City]
As someone who is raising a child without a car in a transit-rich city, I sometimes need to be reminded that for many people in the United States, the reality of maintaining a family life without a personal motor vehicle is impractical -- or simply unthinkable, for a variety of reasons. This often holds true even if they live in a city with relatively good transit.
Many car-free families in the Streetsblog Network have posted great advice for people who want to have kids and take their transit too. Bus Chick and Car Free with Kids are particularly good resources. And today, network member blog Human Transit is featuring a guest post from EngineerScotty, father to "several" small children who is a frequent user of Portland's TriMet system. What's special about EngineerScotty's piece is that he makes some persuasive arguments about why it's good for transit agencies to encourage family ridership:
Some may dismiss families with children as an unlikely (or undesirable) transit demographic, and propose that transit agencies instead focus on those demographics more likely to be transit-compatible, such as childless families and commuters. Families who make the decision to move to the burbs are more likely to abandon transit altogether. A car will be a necessity -- and then a second car will often become attractive. At that point, even the morning and evening commute for the family breadwinner(s) may be instead done by automobile.
Many trips made by families, especially daytime errands with smaller children, are made during off-peak hours -- an important consideration for agencies trying to load-balance (which is pretty much every agency).
Children who grow up comfortable with transit are more likely to use it as adults; those who grow up in the suburbs -- and whose main exposure to "transit" is an uncomfortable yellow school bus -- are more likely to continue an auto-centric lifestyle when they grow up.
Families with children are an important political constituency as well. If they have no stake in good public transit, they are less likely to support it with their votes or their tax dollars.
Children who are of sufficient age to travel alone, but aren't old enough to drive a car, are a natural transit constituency.

Bunning Throws in the Towel, Congress Restores Transport Funding [Streetsblog New York City]
Workers at the U.S. DOT and on transportation projects around the country are back on the job today after Sen. Jim Bunning (R-KY) lost his politically hazardous battle against a 30-day extension of federal infrastructure law and unemployment benefits.

Four members of Republican leadership voted with Bunning: Minority Leader Mitch McConnell (KY), GOP Conference Chairman Lamar Alexander (TN), Conference Vice Chairman John Thune (SD), and campaign committee chief John Cornyn (TX).
"This week we saw the shutdown of many important highway and bridge projects, which caused great concern in many of our states," Senate environment committee chairman Barbara Boxer (D-CA) said in a statement after the vote. "Now I look forward to a longer-term transportation extension with the legislation that has already passed the Senate, and which I believe will pass the House this week."
The legislation Boxer referred to, a $15 billion bill that would keep the nation's highway trust fund solvent until 2011, could get a vote in the House this week. But much depends on how Democratic leaders act to ease the objections of members of the Congressional Black Caucus, who want to see more infrastructure spending added to the Senate package, and the Blue Dogs, who have called for more revenue offsets to the bill.

In Rome a bridge half-way into an important cycle way has been closed for fourteen months, with no notice nor work to fix the problem. Roma Pedala is obviously angry that the makeshift barrier (ignored by everyone) has now been made permanent, making the cycleway useless.
In London, new drawings have been released of the much hyped Super-Cycleway project. If a high-school student had produced such a joke for a school project, he would have been given an “F”. Any teacher would have responded, “Your big idea is changing the colour of the tarmac from green to blue? How is that going to make a new rider feel safer?”
We can only hope that the imminent financial meltdown in the two countries will bring a total devastation of the present political classes and the civil service, which will allow new administrations run by people with surnames that start with ‘van’ or end with ’sen’.
